Is eminent domain legal?
While it may seem unfair to property owners, eminent domain is legal under both the United States and Minnesota Constitutions. Both constitutions require the government to pay a property owner just compensation if it needs to take their property from them. The United States and Minnesota Constitutions only allows the government to take property under two conditions: it will be used for public use and there is just compensation paid to the property owner.
